If they are the parent and they jabe custody, yes, that is one of their rights.

If they have shared custody, an agreement must be made with all persons that have custody as well.

If they are not the parent, then they have no right to take the child anywhere, unless that permission is explicitly granted to them by the parent or guardian.

Can you still stay in the country if you have your green card and are married to a us citizen and have a child and are getting a divorce?

Individuals who obtain a Green Card through marriage to a U.S. Citizen are granted "Conditional" Green Card status, which is only valid for two years. Individuals who have been granted Conditional Green Card Status are required to apply to remove the Conditions on their Green Card within 90 days of the date that their Conditional Permanent Resident status expires that is within their second anniversary and they are still married.

Your husband is a dual citizen and you just got married and his green card is ready to expire do we need to do anything and who do we call?

First question, dual citizen of what country? How did he obtain his LPR "Green Card", through marriage to you or by other means? Any expired green card can simply be renewed at USCIS office, if he maintains lawful permanent resident status. If he was a temporary resident, he will need to remove his conditional residence status, usually via interview with USCIS.

US citizen marries a non-citizen do they become a US citizen?

No, marriage to US citizen does not automatically allow a non-citizen to become a permanent resident or citizen of the US.Marriage does entitle the non-citizen to apply for US permanent residency, provided they can show they will be living in the US. For example, if a US citizen married a German citizen, and they continue to live in Germany, the german citizen cannot apply for a US permanent resident visa. If, at some time later, the couple decide to move back to the US, the German citizen can at that time apply for a permanent residency visa. Such marriage-based permanent resident visas are almost always granted once the couple shows proper residency intent (and, shows that the marriage is not a sham or fraud one).Any non-citizen holding a US permanent residency visa can apply for US citizenship via the nationalization process. The key requirements of the citizenship process are:Be a permanent resident for at least 5 years (or 3 if married to a US citizen)Reside continuously (except for short-duration excursions) in the US for that period of timeHave a clean criminal record, or obtain a specific waiver from an immigration judgeAttend proper citizenship classes

How long can a permanent resident stay out of the US?

As long as he/she wants! However you may create an obstacle to becoming a citizen if you are gone more than 6 months per year. If you have not received a "green card" you will have to obtain "Advance Parole". See website noted in answer 2 and find "forms" for this document. Also see: http://www.uscis.gov/files/nativedocuments/M-480.pdf for a simple official worksheet of basic requirements for citizenship. A Conditional Permanent Resident is issued a card valid for two years. In order to remain a Permanent Resident, you must file a petition to remove the condition during the 90 days before the card expires. The condition must be removed or you lose your permanent resident status The card is valid for readmission to the United States if the trip was not greater than one year in length. If a trip will last longer than one year, a reentry permit is needed. see site: http://www.uscis.gov/portal/site/uscis

What is required to request citizinship after marriage in the us?

If either of the spouse is a US citizen and another is an alien, once they get married the alien is given the conditional status which is valid for 2 years. 90 days or less before the conditional status expires the US citizen needs to file to remove the conditions using Form I-751 for the alien spouse to get permanent resident status or green card. After three years as a green card holder and if still married the person can apply for US citizenship through US citizen spouse by filing Form N-400.

What if your spouse wants a bifurcation to speed up divorce You are a green card holder set to expire soon Gained green card through marriage to US citizen How will bifurcation affect green card renew?

if the green card is conditional - yes, it will. in order to remove the condition and become a permanent resident, you have to be married to the same person who you got the conditional residence through. if you are divorced at the review time, you'll be ordered t leave the country. hire an attorney to oppose bifurcation, most likely you will be able to avoid it. another option: report domestic violence. if you can prove it - you most likely will get citizenship. permanent green card will be just renewed, no regards to marital status. good luck :)

How can a abused and soon to be divorced US citizen deport the immigrant spouse who is on a temp green card?

A US citizen cannot deport his or her spouse (unless, of course, he or she is an authorized agent of the INS) When it comes time to remove the conditions on the green card, the US citizen should not sign the petition and should not go to the interview. This does not guarantee, however, that the person will not get his/her greencard. If the alien proves that he/she entered the marriage in good faith, he/she may still be able to remove the conditions without the US citizen spouse's signature. It is best for the US citizen to get on with his/her life. Whether the alien gets to stay in the US or not is really out of his/her hands.
