You should seek written permission from the father before leaving the state with your child. It will help you out tremendously if the father ever goes after you. If there is no paternity declaration, court orders involving custody and support, etc. I believe it would be legal...just not smart. If you do go without his permission, at least send him a certified letter once you arrive informing him of your new address. If a judge thinks you are trying to hide your child from it's father, he will not rule favorably for you.
