In most states if your bill of sale says "sold as is" you have smogged the buyer. It's a good idea to keep a signed copy of the bill of sale also. Some buyers never put the car in their name. You may get later get parking tickets and even be sued when the buyer wrecks someone else.

Can you sell a car in California and leave the smog up to the buyer?

No, it is the seller's responsibility to provide the buyer with a Smog certificate that is less than 90 days old when selling the car. The law makes no provision for "as is" sales in this matter. I went to the DMV today as I purchased a car that was not smogged and I cannot locate the seller. I was told that I could sell it as is by 2 DMV personnel. Now I am really confused.

Can a seller on eBay not sell the item after you have won it?

No, once an auction has ended with yours being the winning bid, or you if have hit the Buy It Now button, you have won the item and the seller is obliged to sell it to you.In a similar way, the buyer is obliged to pay for an item after they have won it even if they have changed their mind.Sometimes a seller will end their auction early, even if they have bids; it is bad practice from the seller but it is allowed in some circumstances (for example, if the item has been broken) and must be done before the auction ends.If the seller refuses to sell the item the buyer can report them for "seller non-performance" and can leave negative feedback for the seller. If the buyer has already paid and the seller refuses to sell, the buyer can "open a case" with eBay, or PayPal, to get their money back and they can also leave negative feedback for the seller.

If you are the co-buyer and you are the one making the payments can the buyer take your auto away?

Cosigning for ANYONE is one big mistake. If the person you cosign for is not making the payments then the person that cosigned is responsible for all payments. I have no idea why anyone would want to do this. Unless there were stipulations in the contract you signed with the buyer, then no, they can't just up and sell the car. Take another look at your contract. Marcy

What happens if a person sold a property of a deceased person and used a power of attorney?

A POA is extinguished at the moment of death. If a POA was used to sell the property of a deceased person the sale was null and void. The former attorney-in-fact had no legal interest in the property, couldn't sell it and committed a fraud. The buyer did not get title to the property.
