While technically the President cannot declare war without Congress, under the War Powers Resolution of 1973, the President can send troops into combat as long as he informs Congress within 48 hours of doing so . Then he has 60 days and then another 30 days for withdrawal before he has to get Congressional approval or a formal declaration of war. Congress has to approve any additional funds that an undeclared war requires.

Yes- Congress is given the power to declare war by the US Constitution. I presume the President could veto a declaration of war, but Congress could still over-ride such a veto with a 2/3 vote.

The President can not declare war, only the Congress can do that. The President/Commander-In-Chief can send the military immediate into a hostile situation, has to notify Congress within 48 hours of his actions, and then can keep the armed forces there for 60 days, plus 30 days to allow them to withdrawal from the area, without a state of war being declared by Congress.

The President of the United States cannot declare war at all. He can say we are currently in war, however it is Congress that makes the declaration. According to Congress, whether the President says we're in war is irrelevant to the actual case.
