I would think they could. I know that certain jobs require certain health requirements. I am a teacher and I am required to have a TB test every 2 years to keep teaching. In some states teachers are also required to have hepatitis shots to teach. I did the shots, but wasn't required to. With the shadow of a flu epidemic I would think a hospital would require a flu shot to be sure that their employees didn't spread the flu or get it.

New York State has just recently (late September 2009) enacted a mandate that all health care workers must take flu shots. It was the first state to make them mandatory.

Other states may have other requirements, but the shots are not yet made mandatory other than in New York. For example, in Texas the law states that the facility/nursing home/ hospital, etc. must make the flu shots available to employees, but an employee may refuse to take it without penalty. However, hospitals may then require the employees who refuse to use other special protective gear to keep patients safe, such as wearing face masks at all times on the premises.

Check with the state Department of Labor to find out the laws in your state.

It is recommended by the Centers for Disease Control and Prevention that you protect yourself with the vaccinations. The rate of adverse effects is very low for the seasonal flu shots as they have been used and studied now for decades. Obviously, if you have ever had a reaction to the shot or if you have an allergy to the ingredients, eggs, or latex you should not take them. Report to the health care professionals before taking flu shots if you have a history of Guillain-Barre Syndrome, especially if it has been within the last six months.
