The answer depends on several factors that include marital status of the parents. Generally, if the parents are legally married one parent cannot keep the child from the other parent.

If the parents are not married and there is no court-ordered visitation the mother can keep the child from the father but the father can petition the court to establish his paternity and request a visitation schedule ordered by the court. Unwed mothers generally have sole custody until the father takes some action to establish his paternity.

A custodial parent cannot deny the court ordered visitations of the non-custodial parent. Ordinary citizens do not have the authority to supersede a court order. They will be in contempt of court and the non-custodial parent can file for an order of contempt.

No. If a custody action has been filed then the court has jurisdiction over the child and has the authority to render a decision. When a parent has had custody of minor children for 6 months and files for custody and the other parent files a counter suit in another state which suit wins jurisdiction?

It would depend on the reason. If the parent who filed custody over the six month old child from a divorce, but the other parent files a counter suit for the "safety" of the child, then the judge would have to look more into the case because the other parent had already, as it seems from your question, won custody. If nothing is found then the child remains with the custody holder. But, if something is found then the child will be handed over to the parent who filed the counter suit OR will be sent to child services. It literally depends on the case. Sorry.

Can child support be petitioned if custody hearing is pending?

What happens when you are taken to court for joint custody?

The other parent has filed a petition for joint custody. They want to have the right to be included in decisions regarding the child and perhaps want equal physical custody also. There will be a hearing. If you presently have sole custody and object to the other parent being awarded joint custody then you should consult with a attorney who specializes in custody issues who can represent you in the action. The other parent has filed a petition for joint custody. Can you get arrested for taking your children if there are no custody papers?

If a single father, yes, as you have no assumed rights to the child. If married, generally not, but the application of this is less clear as the police rarely ask the mother to prove she has custody. As such, you get arrested and by the time you clear it up, she has filed against you. see link
