Yes, and it has nothing to do with the parents permission or not (although they can report it to law enforcement). The legal age of consent in WV is 16 but because of the age difference between the 16 year old juvenile and the 21 year old "boyfriend" is too great, he is too old to have sex with you according to the wording of the applicable WV State Law.
