∙ 12y agoYes, you can divorce even if the wife is pregnant. If you are filing without a lawyer, you must use the Dissolution of Marriage With Children Petition even if you don't have any children together. The instructions for that for say....
You and your spouse have a dependent or minor child(ren) together or the wife is pregnant.

∙ 13y agoActually, the courts used to REFUSE to allow spouses to divorce is the wife was pregnant. Some are still reluntant to do so.
Now, as long as we provide for support and care of the unborn child, the Court will allow the divorce to proceed.
Please note: If your wife is pregnant by another man, the husband is STILL the LEGAL father of the child. Unless you can bring an alleged father into the picture, you may have to pay support on this child.
