Filing bankruptcy creates an "automatic stay" which is a court order stopping most efforts to collect a debt, including lawsuits. Whether or not you are eligible for a discharge of the particular debt depends on the type of claim filed against you. Certain debts are not dischargeable. The decision to file bankruptcy and which type of bankrupty to file should be made after consultation with a qualified attorney. You must another an number of factors into consideration such as the amount of your dischargeable debt, value of your assets, income and expenses.

BK generally won't discharge a judgment from a lawsuit filed before the filing of the BK.

A sttlement may be a different story...but if you settled today and went BK within the next few years at least, it would probably be exempt from BK discharge, or even reopened, as something done in anticipation of BK...and as it may seem you tried to use/trick the courts and law into getting you out of your legal obligations and responsibilities, not be looked at too well.

Yes, but if you caused the injury due to an intentional tort or drunk driving, then the creditor can file a motion of non-dischargeability, meaning you would still owe the money. If the p.i. was only based on negligence, then the judgment IS dischargeable.
