If you were charged but the court action has not yet taken place, then you are either released on bond or on personal recognizance - both of which require certain things of you. You may (and probably do) have travel restrictions on your freedom of movement (especially on a felony charge). If you are bonded out, pay particular attention to your bailbondsman, if they get the impression that you are trying to flee they WILL come after you and/or revoke your bond with the court which would have the effect of putting you in jail until your next court appearance. Just because you are free, does not mean that you are "FREE."
If you are out on bail, probation, or some other type of court sanctioned release awaiting trial, you would have to check with the court. It is VERY likely that you are under some kind of travel restriction and it might not allowed.
If you were not convicted of an act of treason or drug trafficking, there is a chance you will be allowed to leave the country. You should apply because they do grant approval in some cases.

Define what is meant by "pending." If you are charged and released on bailbond prior to court action your travel may be (and probably IS) severely curtailed.
