On any motorbike the law requires the rider and the passenger(if there is a passenger) to be wearing a helmet at all times whilst the vehicle is moving.

you can be arrested for this. that would be the same as driving a car on the side walk. i saw a kid driving a scooter one block on a side walk in miami and watched him get arrested for reckless driving on a sidewalk. a 49CC scooter has to be driven on the road with a license plate like a car.

Any motored vehicle to be driven in the state of FL streets need to be tagged. In order to be tagged it must be street legal including Horn, signals, lights and must not be over 49cc to be driven without insurance. It can be driven offroad without restrictions, but to be on the street the driver must be at least 16 years old, wear a helmet, and drive with NO passengers.

As long as the scooter is 50cc or less (49.5 cc = 50cc to the state) and you are 16 or older you need a regular driver's license. However - if it has actual pedals on it and it is 50cc or less - it is considered a moped and you do not need a license. I know I drove one for years here in FL without a valid license (suspended for speeding WAY over the limit - youth and stupidity sometimes go hand in hand. Also - you have to be at least 16 to ride a scooter (permit is acceptable if someone is following you on another bike or scooter or car.
