The employer does not have to pay for the spouse's coverage. It can be offered to the employee and the cost taken from his/her paycheck to cover the spouse.

There is no legal requirement for the employer to offer coverage for spouses -- even at the employee's expense. However, it would be very unusual for a plan to cover only employees and not have coverage available for spouses and children.

Does employer have to provide health insurance for employee's spouse?

No. Federal Law (ERISA) does not require that health benefits are offered at all. They can make those restrictions if they want to.

Can an employer deny coverage to spouse who has lost health insurance?

Assuming the employer offers coverage to spouses, then the employer would not have the right to turn a spouse away. The spouse's loss of coverage is a "qualifying event" and the employer's insurer would allow the spouse to join.

Can your employer's health insurance require your husband to take his employer's health insurance if his is not free and not as good as yours?

My employer requires that my husband participate in his company's health insurance or they will drop him from their insurance. Insurance is a choice offered as a benefit by the employer because the employer is paying a portion of the cost to be insured. You do not have to participate if you don't want to. Also, the question being answered is that can an employer force an employee's spouse to take coverage offered elsewhere: NO. If a company offers a family health plan, they CANNOT specify that a spouse take other insurance if available. They CAN require that if you are declining coverage from them (your own employer), that you show you have coverage elsewhere.

Can an employer legally deny coverage for a spouse if the spouse's employer offers health insurance and the spouse is pregnant?

Generally insurance coverage should be offered to an employees spouse. It does not matter if they are offered coverage from their employer whereas it provides an additional option in case 1 plan is more affordable than the other.

Do you have to take your employers health insurance or can you remain on your spouses health insurance under the new ObamaCare?

You will have a choice between your employer's plan and your spouse's plan. Your employer may ask you for proof that you are covered by your spouse's plan. Your employer's plan will want this, in order to ensure that people are not dropping out for other reasons (such as they can't afford to join).

How can one obtain individual health insurance after a divorce?

To continue individual health insurance after a divorce, one can apply for an insurance coverage under the Federal Law COBRA. It means that person will be covered by his/her ex-spouse's insurance plan obtained from the ex-spouse's own company or employer.

Can an employer force spouses off of the health insurance plan if they have a health insurance plan available to them through their job?

To my knowledge- No they cannot. It almost comes down to discrimination. If they offer insurance to one spouse then your employer shouldn't be able to turn to another person and say "sorry.. your spouse has health insurance options at her job.. denied!" You will be the one paying the premium to carry your spouse! I have honestly never heard of this happening. You should contact your corporate HR though. Hope this is helpful:) Evan

If you and a spouse have different health insurance but have never designated one as primary or secondary could this cause problems when you do designate primary or secondary?

If you have insurance through your employer, and you are the policy holder,(the insurance is in your name) this insurance will be primary for you, and your spouses insurance policy will be secondary. The insurance policy thru your spouse's employer, (your spouse is the policy holder, or the insurance is in their name), this would be primary for your spouse, and your policy would be their secondary. How can an employer cover spouse and kids on health Insurance and then a year later say that the children are not covered because the other spouse has insurance coverage on the children?

Only one company can pay out on the health insurance so it is a waste of money being insured twice, and also it will save you the tax you are paying on the premiums.
