A US citizen cannot deport his or her spouse (unless, of course, he or she is an authorized agent of the INS)

When it comes time to remove the conditions on the green card, the US citizen should not sign the petition and should not go to the interview. This does not guarantee, however, that the person will not get his/her greencard. If the alien proves that he/she entered the marriage in good faith, he/she may still be able to remove the conditions without the US citizen spouse's signature.

It is best for the US citizen to get on with his/her life. Whether the alien gets to stay in the US or not is really out of his/her hands.

The same way you divorce anybody else in that country. Talk to your lawyer.
