If he has abandoned the mother, talk to a lawyer. There may be a law in your state that after so many years of 'abandonment' custody is automatic. Get a lawyer and file for full custody if abandonment is not the issue.

I just found out that I am the biological father of a child in state's custody how do I get custody?

If you're a single father, you have no assumed rights to the child until paternity has been established by a court of jurisdiction. As such that will need to be your first step. Then, if the child is in the custody of the state you can petition for custody to be transferred to you. You should consult with an attorney who specializes in family law who can review your situation and explain your options.

No, the mother is no more entitled to custody than the father. For example, if you moved out and left the child in the care of the father, you forfeited your custody rights until an official custody order has been established.

When the father of a minor child dies does the biological mom have to file for custody and to avoid the fathers guardians from trying to obtain custody?

Only if she did not have parental rights when the man dies. Otherwise she automatically gets custody unlesss she is unfit. It is assumed the couple was not married. In the United States an unmarried biological mother already has legal custody of her child unless her parental rights have been affected by a court order. If the child was living with the father, his family may petition for custody and in that case the mother should contact an attorney who specializes in custody issues or visit the family court and ask to speak with an advocate.
