I think it would depend on what drugs the mother had done while she was pregnant. I also think that any pregnant woman that does drugs, knowing the risk factors, and the harm it could do to her child, should face some sort of huge punishment.

And while it DOES depend on the drug used, if they suspect drug use and are very motivated to do so, they can take a look at the cord blood or the placenta I believe, and it would still have traces in it. But they'd have to be specifically looking for that, it wouldn't happen by accident.
