Because he had a huge income from his illegal activities, Al Capone was arrested in 1931 for income tax evasion, a federal crime. He was convicted in October 1931 and spent 7 years in prison, including time in Alcatraz.

Al Capone was never caught because the people, jury and the prosicuters did not have enough evidence/proof to send him to jail.

Another View: The above explanation is not EXACTLY the case. Capone was careful never to be linked to violations of the federal Prohibition Act, and he was only charged with crimes and violations of Illinois State Laws. Therefore he was tried only within Cook County Courts (his home territory) and he either bought off the judges, witnesses, and/or jurors, or he threatened and intimidated them sufficiently that they never returned a guilty verdict against him.

THAT is why the Feds finally entered the picture, and conducted a lengthy FBI investigation, led by the legendary Elliot Ness. Capone was finally convicted of income tax fraud and sent to prison.
