My husband is trying to get in to the Navy and he has to many misdemeanors from 9 years ago

ANSWER:I don't think you can erase anything that's on the record and their is no time limit or statute of limitations that will take them off of a criminal record. If any of these happenned as a juvinile, you can request to get those records "SEALED" and they will not show up on current records.

In some US states it is possible to have a non-violent related misdemeanor deleted from "public" viewing only if it is creating a hardship on the offender and/or his family. The concerned party should consult with an attorney or qualified legal advisor to determine if he or she is eligible for such an action.

Clearing your record doesn't have to be too hard. All you have to do is find yourself a legal advisor that will walk you through the process. Nowadays there are hundreds of websites that offer those services, but you have to be careful who are you going to choose since some of them are not really lawyers, but only paralegals(and they often charge you the same).

Present a petition/motion to the court requesting your record be expunged and setting forth the reason(s) you believe it should be granted. A judge will consider the request and either approve or deny it.

It really depends on what state the misdemeanor occurred in. Many states do not permit expungements of convictions or even arrests (for misdemeanors or felonies). For the best answer, you should specify which state you are referring to. Some states do not even permit expungements of violations.

Unless it was commited prior to your 18th birthday an adult criminal record stay with you for life, it doesn't "go away" with time. To request an expungement: You must have served the complete term of your sentence - then submit a petition to the court setting forth good reason(s) why your request should be granted. A judge will review your petition and the circumstances of your case and issue a ruling either granting or denying the request. AN EXPUNGEMENT IS NOT A PARDON! Expungement only removes the record of your offense from being viewed by the public. Law enforcement, the courts, and government agencies will always have access to your complete 'actual' record.

First, you would not pay a company that says they can do this for you. Depending on the offense, you may need to hire a lawyer to help you through the civil process.

Youthful "indiscretions," or other incidents that occurred quite some time ago, without being repeated, are often reasonable candidates. If the offense caused you to be listed on a list of sexual offenders, or other list, the chance of having your name removed from the list is unlikely. In any case, if you are applying for a job, you may still need to list the conviction as being expunged, since a background search is likely to find a citation of the offense.

Unless it was committed prior to your 18th birthday, it will always remain a part of your adult criminal history. You must request an expungment of your record. The procedures vary in all states. You will have to check the protocol for your own state. Be advised: It is usually NOT a "do-it-yourself" project.

Can you get police clearance if you have been arrested before but have not been convicted?

I believe that there is confusion in the questioner's mind over the term "police clearance." As commonly used, that term refers to the record search of the individual's own criminal history. If the individual has a criminal history, the police will furnsih them a copy of it, showing what offense(s) the individual has in his file. If the individual has NO criminal record the police will issue a notice of "No Record On FIle." Hence, the individual will have a "clear" record. Someone who has been arrested, but not convicted, of a crime WILL have a record of the arrest and the reason for it, on flile, thus, that person's record will NOT be "clear."
