If you have custody of your child and you want to give full custody back to the mother, you need to file new papers with the court. The papers will make the change in custody legal. There does not need to be a trial when both parents agree on what's best for the child unless the mother was found to be unfit.

You have to address the issue with the biological father to see if he will give up his parental rights with no reservations. If he does it may be as simple as going to the courts with the proper papers to file. If he will not then you have to prove why you should be in full custody and file that with the courts.

By filing the necessary petition in the court of family law in her county of residence.

In all states, courts prefer that both parents be involved in the child's life, so you would need to provide compelling and documented evidence why you should be awarded sole and full custody especially if the father's parentage has been established, either by inclusion on the birth certificate or established after the fact in a court of law. It's also going to be tougher if a custody agreement is already in place.

An attorney specializing in family law should review your case to see whether or not it is viable.

Court orders must be followed until they are modified by a judge. A custodial parent who doesn't honor the standing visitation order is in contempt of a court order. A child cannot refuse to visit the other parent until they reach eighteen years of age in virtually every state in the United States.

Your mother would need to schedule a hearing at the court with jurisdiction over your case and petition that court for full custody. She would need to provide evidence as to why the circumstances have changed enough for her to request sole custody. Courts are not likely to change the current custody order without a good reason. Courts always favor the presence of both parents in a child's life.

When a child is reluctant to visit the other parent the primary custodial parent must first take steps to determine the cause. A professional may be of help at this time. The child may have legitimate reasons and once identified both parents must work together to address the problem. The non-custodial parent may need some advice on how to spend quality time with the child so the child feels both welcome and comfortable in the non-custodial parent's environment.
