The best time is 15 weeks but you can have your first baby scan even at 9 months. Nonetheless, the later, the more accurate it is. Your baby's gender won't get determined that soon though that's why I advise you to wait till it's the 15th week.

Well, believe the 8 wk. scan because that is an actual scan of the uterus- it's right. Pregnancy tests just show a change in hormone activity or concentration- this could have been changed just from having sex in the first place. A lot of pregnancy tests give false readings. If your scan shows empty, you're not pregnant. Or possibly your not quite 8 weeks and thats why its not visiable in a scan.
