Depending on the state, retroactive orders are 2-18 years, but Judge David Grey Ross, Commissioner of the Federal Office of Child Support Enforcement opposes the program, and a growing number of family court judges are following suit.

The existence of the law does allow female pedophiles, who were not caught at the time of the they were sexually abusing boys, to wait for the statute of limitations on being charged with a crime to run out, than file a retroactive claim against the now working adult. In the summer of 2009, a 19-year-old Texas boy was hit with 11 years ($20,000) of retroactive child support. In 1998, a 27-year Michigan man was ordered to pay 14 years ($85,000) of retroactive support.

He most interest case I've seen was a woman awarded $120,000 in retroactive support, which she used to buy a home, and other things for her, her current husband, and their combined children. A year later, it was all lost when her husband was hit with an even larger order, costing them all their jointly held assets. Assets she had gained by taking it all away from the father of her oldest child and his family. Now that was Karma.

Generally you cannot unless there are extenuating circumstances. Some examples of such are if the father was not able to be found and/or a paternity test had not been taken to prove who fathered the minor child.

Does the statute of limitations to file child support ever run ou t in Michigan?

While there is no statue of limitation for collecting court ordered unpaid back child support, there is for unordered support...the age of 21 of the dependent child. The child at the age of 18 may sue the noncustodial parent for unpaid support that was not ordered by the courts. This has been done at least twice.

What are the parental rights when the child has been given legal custody to the grandparent from CPS?

Legal Custody is different than Parental rights. The courts decides child visitation, etc. and parents could pay child support to grandparent. It is all up to the courts..

Will you still get child support payment if the father is on welfare?

Child support is calculated based on income of the father (or mother in such a case). If the father is unemployed his child support will still be calculated based on whatever minimum wage is in your state. The only time this does not apply is when the father is on disability. Welfare shouldn't matter.

Is the balance still owed after child support has been dropped?

If a parent drops a child support claim and the award is reversed through the courts, yes any amount that is over due is considered to be in arrears and is still owed.

Can a child who has become an adult cancel back child support owed by the non-custodial parent?

No. The back child support is owed to the custodial parent and the amount due doesn't go away until it has been paid.
