In North Carolina you have to be 16 years or older to move out of your parents' house, but you have to be in school and hold a part-time job as well.

In NC, unless you have been emancipated by the court, you are considered to be a minor until you're 18, so until that time your parents have the authority to decide where you can/can't live. You can, however, petition the court for early emancipation.

so, what is the answer? 16...or 18? I talked to an officer today and he said that as long as the child is 16, the only thing a parent can do is call the law to find out where the child is. The officer can find the 16 year old and report back to the parents on the where-about of the child....BUT CANNOT make the 16 year old go back HOME!!!!!! Lexington NC

North Carolina (and every other state for that matter) considers anyone under the age of 18 to be a minor. As a minor, your parents have the control/authority to decide where you can/can't live. However, NC does allow minors who are at least 16 to petition the court for a decree of emancipation. Among other thing, you will have to prove that you are capable of supporting yourself (and that means of support can not be public assistance). You also have to prove that it's in your best interest to be emancipated. That's not always an easy thing to do. The courts generally don't like to override the authority of parents, so you would have really prove your case. The courts then decide rather to grant or deny your petition. It is not a quick and easy process.

In North Carolina you can leave home at 16 years old and a parent can not make that person come back home. If a parent calls the Police and reports the person has run away all they will do is, call the parent if they locate this person and tell them where they are at, but they will not pick them up and bring them home once they are 16 years old.

North Carolina's legal age of majority is 18. Younger than that and you will need parental permission or legal emancipation or a court order giving another adult legal guardianship. The employment status is not relevant, however the educational aspect would play a large part in any decision of the court.

Some may say that if a child keeps running away the law gives up on them and they're out on they're own but that does not make it legal and it also depends on the child's age.

The age of majority in NC is 18. The NC Juvenile Code states that any juvenile under 18 years of age is subject to the supervision and control of the juvenile's parents unless they are married, serving in the armed forces (both of which require parental consent) or they have been granted emancipation by the court. In NC a minor who is 16 or older can petition for emancipation.
