Before a creditor could garnish the wages of a debtor a lawsuit would have to be undertaken and a judgment entered against the debtor. The judgment could possibly be executed as a wage garnishment according to the laws of the debtor's state of residency.

In Indiana, a credit card company can only garnish wages if there has been a judgment against you. If they sued you, and you lost or did not show, and the Judge determined you owed, they can garnish you. They can not do it on their own.
