What is the first and last rule?
The first and last rule generally means that when you move-in you are required to pay your first month rent and your last month's rent. A security deposit may also be charged. But oftentimes your landlord will work with you in making security or last month's rent deposits. The difference between last month rent and a security deposit, both which can equal the same amount, is that the last month rent is used to apply to your last month of rent, while the security deposit is refunded to you provided you leave the apartment in good condition minus reasonable wear and tear. Your security deposit is generally not applied towards your last month's rent, especially if you did pay a last month's rent in advance.

Is it illegal to rent your house if it is in default IF you properly disclose to the potential tenant that it is a month to month lease because the property is going to be in foreclosure?
The fact that a bank has begun foreclosure proceedings shouldn't have anything to do with signing a lease or month-to-month rental agreement. We can't be certain that the foreclosure will happen, or when. And, it could be that the bank with work with the owner if the place is rented, where they would not if it was empty.

Can a court date be postponed until you pay what you owe for rent?
I would guess that your situation is that you will not be able to pay your rent if you take time off work in order to appear in court. The problem with this situation is that you pay rent every month, and so no matter when you take time off work, it will affect your ability to pay your rent (unless for some reason this current month has been unusually expensive for you). It would seem that your best approach, if your finances are that precarious, would be to try to schedule a vacation day that will allow you to appear in court and still be paid your usual amount. You can certainly petition the court for a postponement but I don't think you have a strong case, unless you can show that you are not just putting off the problem of paying rent from this month to next month, and even then, the judge may not be sympathetic to a person who has no savings, no reserve, and spends every penny the instant he or she obtains it. A prudent person knows that there will sometimes be unusual expenses in life, or interruptions of income, and prepares.
