If you were never married to the father of the child(Children) custody HAS NOT been established. You must go to court and have custody determined. My child lived with me for 5 Years. The father paid support to the state of Missouri Which I entern received, and he visited on occasion. One weekend he picked her up for a visit and disappeared. No one would help because custody was never established. He had just as much right as I.
The childs' father, married or not. Your relationship to the father is irrelevent. The father is the first on a long list of family members. Create a living will if that is not acceptable.

In Georgia if the parents are not married at the time of the childs birth the fathers name may be put on the birth certificate but this alone will not be legal in custody matters. The father must legitimize the child as his own by taking a DNA test and having the necessary legitimization paperwork done, (usually by an attorney) and taking it in front of a judge to have the legitimization granted before any distributed custody can be determined. Generally, in the United States, if the parents are unmarried the mother has sole custody and control in most states until the father can establish his paternity. Remember, a child's mother can always be identified by medical records. Since the father didn't give birth and he was not legally married at the time of the birth he must establish his paternity by signing the birth certificate at the time of birth (waiving DNA testing rights) which must be done with mother's consent. If he doesn't sign the birth certificate then he must seek another way to establish his paternity and that is done through a DNA test. A paternity test can be arranged through the court. Once paternity is established in court, the father can request visitations or custody through the court. If the mother retains physical custody she can request that the court issue a child support order. If the father gets physical custody he can request a child support order.

Both full custody parents/guardians have say over the child. However, just because you are someones guardian does not mean that you have full custody of that child all of the time. It simply means you have say so in the childs life. This is how it was when my grandmother had full custody of me, however, my uncles were my guardians. I do not belive this particular law varies from place to place.
A responsible adult in the family should try to contact the childs social worker and express their interest in becoming the childs permanent guardian. That person would need to file a petition to be appointed the childs guardian in the probate court. That step should not be taken lightly but only if the adult wants to provide the child with a loving, stable home, financial support, address medical, emotional and education needs and step in as the childs parent. If possible they should consult with an attorney who specializes in custody and guardianship issues. An attorney could help the process go more smoothly and possibly more quickly since they would be familiar with the court and the process.
