No, sadly enough the State of Virgina will not permit such an act because neither of the two partners is of a legal, consenting age. In other words the stae will consider them to be children. However if a crime is committed of great offense, then the 16 year olds can be tried as an adult to the maximum punishment. Isn't the law fickle?

No. But you can get emancipated. Yes, Virginia law has special provisions that allow marriage of underage parties when pregnancy is the issue or if the minor already has a child. At the time of application the pregnant minor must present a notarized statement confirming the pregnancy from a physician licensed to practice in the state. If the minor already has a child they must bring the birth certificate and any official court orders/papers (such as custody orders) at the time of application. Virginia also has established grounds an procedures for emancipation of minors, however cases are adjudicated on individual merit and dispensation is at the discretion of the presiding judge. VFC 16.1-331

You are both underage, but, some courts will grant a marriage (you will have to take a course on marriage) because there is a pregnancy involved. Don't feel marriage is the only exit you have because you are pregnant. If you don't feel ready to settle down, then really think of adopting your baby out. I know this sounds callous, but, you must do what is right for that little baby. This is a big step I know, but teenage marriages and all the responsibilities of paying the bills and now raising a baby is too great for many young couples and their marriages usually end up in divorce. In the State of Virginia

anyone 18 years old or older is able to secure a marriage license and marry without parental permission. Someone, between the age of 16-18 can also be married in Viriginia with two requirements: the partner must be 18 years old or older and the 16 year old must have parental consent to marry.

Marriage licenses must be secured from the local Circuit Court Clerk's office and the fee is $30.00, regardless of where in Virginia the marriage takes place. Normally, the Judge does not perform marriage ceremonies

at the Courthouse, however ministers and other Clergy can seek authorization to perform this ceremony. Some Clerk's offices retain a list of authorized people who can perform marriage ceremonies at some Courthouses in Virginia

In almost all states the 16 year old would have to have written parental consent. Call your local court house to find out.
