A judge won't take a happy child out of a home, they think about what is best for the child. If the mother is abusive, it is another story. You must have evidence of that, you cannot make statements without hard evidence or it will simply be your word against hers. If the child is old enough, their testimony may be used and child protective services may have a part in this. It will be a hard road, but if the child is not in good hands and is neglected, then it may be worth it for the child and you.
