What rights exist for the grandmother of a newborn whose minor mother has been declared unfit?

The father would have priority unless he has been deemed unfit or does not want custody. If the father consents the grandmother will likely be appointed legal guardian. If he objects there will be a hearing at which both sides present evidence to support their request for custody and the court will render a decision based on the best interest of the child. The grandmother should consult with an attorney who specializes in custody issues.

If Grandmother has permanent legal and physical custody of grandchild and father want the child will the courts grant it?

Depends on whether the father is a more suitable or equally suitable gaurdian for the child in the opinion of the court. If he can show that he is equally able to provide for the needs of the child and that a change in custody would not be detrimental to the child then he can be awarded custody.

How do you go about giving full custody back to the mother?

If you have custody of your child and you want to give full custody back to the mother, you need to file new papers with the court. The papers will make the change in custody legal. You want to gain custody of your child. Do you have to get a lawyer in the state where the child resides?

Generally, you must file for custody in the state where the child resides. You do not have to be represented by an attorney in order to file a petition for custody. However, since you would be asking the court to take legal custody from someone else, you need to present your case in the best light. You need expert assistance.Anyone who wants to gain custody of a child should be represented by an attorney who specializes in custody issues in the jurisdiction that has jurisdiction over that child. State laws and court practices vary from state to state. You need an attorney who knows the law and who is familiar with that particular court. That attorney can review the situation and explain your rights, options, and the likelihood of your gaining custody.

If a grandmother has the child and the parent did not sign custody papers can the grand parent file for child support in the state of North Carolina?

Yes who ever has the child legally can file for child support. But you have to demonstrate to the court that the child has been residing with you and you have the physical custody and you want to keep the physical custody and give the other parent visitation and joint legal custody. The other parent has filed a petition for joint custody. They want to have the right to be included in decisions regarding the child and perhaps want equal physical custody also. There will be a hearing.
