More than likely the child will be placed in the biological fathers custody in the event of your death.

If the father is not in the child's life it will be best to have him relinquish his parental rights so in the event of such accident the child can legally reside with your family.

In California what do I need from parent of 17 year old to have him legally stay with me he's not my child.?

The parent would have to go to the Court and assign you as the 17 year olds Legal Guardian..If the Mother and Father share joint custody of the 17 year old then you will need the permission of both parents.

Can you share joint custody with a family member besides the children's biological father without his consent?

No. Only parents are granted custody of their children by a court order. You cannot assign custody to a non-parent nor will the court. When a party other than the parent gets "custody" of a child it is done via a guardianship and must be obtained through a court. The person who requests the guardianship is appointed the child's legal guardian, the child is deemed the guardian's ward, and the case will remain under the jurisdiction of the court. What is the leagal age for a teenager to decide which parent he wants to live with in Indiana?

does a child's age, being 12 yrs. old improve my chance of gaining custody of my daughter,in Indiana? As a minor, you don't really have that right. Custody has to be arranged by your parents; if necessary, a court will assign an advocate for you to advocate your rights in court, but the court would still then make the final decision.

Can your friend sign over rights of her daughter to you if her daughter is in DHS custody?

No. When a minor has been remanded to the custody of the state only the court can assign legal guardianship or take action against the rights of the biological parent(s).

Does the husband of a grandmother have any rights to the grandchild?

The husband of a grandmother is often the grandfather. In general, however, grandparents do not have rights to a grandchild unless the parents are dead or legally incapacitated and the grandparents are the closest competent relatives. Even then, a court must first assign custody to the grandparents, it does not come automatically.

If a 17 year old is leaving with their father who does not have legal custody can the mother give them permission to live somewhere else?

It depends on what state you are in and if your mother has legal custody. In many states, she can assign a temporary guardian for the few months left until you turn 18. However, if your father objects to this, even without custody, it can still lead to complications.

Why is child support and child custody so unfairly separated It's like saying you pay have to pay for the car but you don't get to drive it?

They're not "unfairly separated." You participated in the creation of a human being. It is now your responsibility to provide for that human being until it becomes an adult. Courts generally assign custody based on what they think is best for the child. If you disagree, you can always petition to have it changed. They assign child support based on the relative ability of the parents to pay. The economics and culture tends to work out that the mother gets custody and the father pays most of the child support. That's not "unfair", or at least it's no more "unfair" than the fact that women tend to be paid less than men doing the exact same job. If you're not complaining about the one, you don't get to complain about the other.
