You received the terms of your probation at the time you were sentenced - READ THEM! If you violate any of the provisions or restrictions set forth in those documents then you are in violation. If travelling or leaving the county/state/country is one of the restrictions then you have committed a violation.

Does a probation violation for drug paraphernalia ever go away after time?

This depends on what you mean by go away. If you were arrested for possession of drug paraphernalia while on probation this will always be on your arrest record. If you are referring to being on probation for drug paraphernalia and a probation violation warrant is active then no it will not go away. It is possible to get a lawyer to enter on the case and maybe get Court date without having to be arrested.

The condition of probation refers to the terms and requirements that an individual must adhere to while on probation. Will your probation be revoked if it is violated for the first time but is not a drug related violation in Tyler Texas?

no Probably not but any violation of the terms of probation is grounds for revocation. It depends mostly on the mood of the probation officer, current policy, and the nature of the violation. Other factors include the nature of the conviction, the class of offense (minor misdemeanor vs. major felony), how crowded the jail is, or if TDCJ is accepting prisoners, etc.

No. If you fail the drug test twice they will decide you are not attempting to mend the error of your ways and send you to prison.

Why might some probation be kept in the same community after a technical violation rather than having their probation revoked?

A technical violation such as testing positive for drugs can usually be addressed by having the offender attend a treatment program. I know by experience if everyone on probation that tested positive for drugs was revoked, 75% of probationers would go to prison. Judges usually wish to exhaust efforts to allow offenders to attend community treatment programs first, including residential treatment, before sending them to prison for drug usage.
