It is. The Supreme Court has the power to declare any action by Congress, the President, or the States to be unconstitutional and therefor illegal. It can reinterpret the constitution to mean whatever it wants it to mean, and therefor can amend the constitution without a vote of the people. Once it interprets the constitution, that interpretation cannot be undone by Congress or the President. Supreme Court interpretations can only be undone by amending the constitution which has only been done twice in our history, the last time over 100 years ago. Anyone can seek a reinterpretation of the constitution by bringing a test case. This is known as them"constitutional project" as it has been done by both liberals (abortion, sodomy, death penalty) and conservautives (Citizens Untied, free speech, and gun control), although conservatives would argue that they are restoring the original meaning of the constitution rather than amending its meaning. So yes, today the Supreme Court is the most powerful branch of thevU.S, government.
Supreme Court is not the most powerful branch... In fact no branch is more powerful. The Supreme Court isn't really a branch anyway. It is the highest court in the Judicial Branch. Under it are two different courts- the courts of appeal and the district courts. Supreme Court has 9 justices.
No, it isn't suppose to be. As the founders envisioned the 3 branches they wanted to make sure that none of 3 were more powerful than the rest, but through the 200 years of government there have been people who have tried to swing the power one way or the other. The most recent Presidents have worked at enlarging the powers of the executive branch and making it more powerful than the other 2. To some extent they have been successful in this and this creates an unbalance of power.
The Supreme Court
The Supreme Court is the most powerful federal court. The Courts of Appeal are the most powerful courts most litigants will ever reach (the Supreme Court only hears a tiny number of cases a year). The District Courts are the trial level courts.
In the United States, the Judicial Branch contains the federal courts. The Justice Department is an executive agency in charge of enforcing the laws. The Supreme Court is the most powerful court in the Judicial Branch. (Judicial Branch being in America.) It is the most powerful court in the country when dealing with federal questions (federal laws or constitutional issues). However, the Supreme Court has no power to reverse state courts when they make rulings based purely on state law (including state constitutions), and there are no outstanding federal questions in the case.
The Supreme Court is most closely related to the judicial branch of government.
