The answer is- depends on the law where the property is located. What you are doing is an "eviction for nonpayment". You will need to send them a "Notice to pay or quit". Basically telling them to pay up, or quit (leave) the premises. Your best bet on short notice is to find a rental agent in your area that you can talk to- you may need to take legal action, filing for an eviction order. But the notice to pay or quit MAY be all you need- if they pay, or leave. Good luck-

This is known as a monthly rent agreement. It can also be known as a lease. But in the case of the latter, it's for a fixed term, generally one year, during which you are obligated to abide by the terms of the lease, as is the landlord. Some rental agreements are not leases, in that they don't require you to honor it for a fixed term: they simply state the rules by which the rent is paid and that the tenant is expected to conduct himself on renting the dwelling, but may allow the tenant to move out anytime he wants to, given the proper notice. If there is no right whatsoever - simply given that the landlord collects the rent every month and the tenant pays on time - then this is called a verbal or oral lease, of which, in most states, there is no legal binding except the laws that each state has which gives the landlord and tenants basic rights under those laws.
