No, the Shivering Isles is not written into the original version of the game. You can go there if you get the Shivering Isles expansion on a separate disc, the GOTY version includes both official expansions.
if by oblivion you mean the elder scrolls then no, the game of the year edition is the original game and the expansion packs all on one disk, either way it is the same game besides the fact that the game of the year edition has both expansion packs on it, the knights of the nine and the shivering isles.

As far as I know, there is no legal method for getting The Elder Scrolls IV: Shivering Isles on the XBox 360 without paying. I do believe that they offer a trial version that you can download from XBox Live, though you will have to pay approx. $20 to $30 to get the full game.
You can use the command creature spell to get one to follow you, or if you have the Shivering Isles pack, you can complete the quest " Ushnar's Terror," and he will give you one of his "old dogs" which is actually a skinned hound. That's it without mods.

It does matter, because it loads up resources which are installed onto the hard drive when you install Oblivion itself. Without having Oblivion, you don't have access to any of the game's textures, meshes, etc.
Just go through with the installation, I believe that Nehrim automatically creates it's own files and folders on installation. It works fine for me.
