It is standard in the United States for children to have their father's last name, unless a child is adopted by a different couple. It does not matter if the parents do not live together. In Spain, A son will generally have his father's last name and a daughter will have her mother's last name.

No. You can name your children anything you want. Some people opt for a hyphenated version of both surnames: i.e. "Smith-Jones".
