Children should be able to visit a parent in prison as long as the parent did not do an offense against the child. It should also be up to the child if they want to see their parent in prison.

Should the court rule that a foster parent be held responsible to transport their foster children to visit the natural parent?

No. The court should not rule that a foster parent be held responsible to transport foster children to visit a natural parent. The duties of the foster parent are governed by a contract between the foster parent and the state. When the court places extra duties and expenses on a foster parent without arranging for payment for time and expenses, the court is placing an undue burden on a particular person. Such is not the duty of the court. The court does not run the foster care program. The Administrative branch of government is assigned that responsibility. The court should not place an unfunded mandate on foster parents.

Is the non-custodial parent required to visit the children?

No. The court cannot make a parent spend time with their children. Visitation orders are only enforced on the custodial parent. If the non-custodial parent doesn't follow the visitation order the courts cannot force them to.

Does a child at age 13 have to visit a parent with visitation rights in North Carolina?

Yes. The non custodial parent has every right to see his or her child. And there is a huge misconception that a child can decide which parent they prefer to live with or decide they don't want to visit the other parent when they reach a certain age. The fact is, it is NOT the child's decision to make, but the judge's.So unless the non custodial parent has been found unfit, abusive, etc., the child has to concede to the visitation rights.Furthermore, the custodial parent should encourage the child to want to visit with the other parent. Children need both parents, and no parent should ever be deprived of spending time with their child unless they are unfit, abusive, etc.

Child Visitation Letter?

Get StartedWhen a divorce decree awards custody of minor children to one parent, visitation rights are generally given to the noncustodial parent. Some courts also recognize that grandparents have visitation rights. The divorce decree often provides specific details regarding child visitation. This document allows either parent to advise the other parent of the arrangements for a child's visit. Does the non custodial parent have the right to move within the state and not tell the custodial parent the address and phone number?

Generally the noncustodial parent may move anywhere - within or outside the state where the children live. The court grants the noncustodial parent the right to visit the children but does not force the noncustodial parent to take advantage of that right. However, a court may require the noncustodial parent to provide the custodial parent with contact information and, where issues develop about the care or safety of the children, the court may require supervised visitation or at least that the noncustodial parent advise the custodial parent where the children will be.
