During the Constitutional Convention, states had disagreements over whether representation in Congress should be equal or based on population. This was resolved by having a Congress made up of two houses. The Senate has two representatives for each state, while the House representation is based on population.

The disagreements during the debates were caused by the ideas that a larger state could dominate the power of a smaller state in the votes of two houses of Congress (The Virginia Plan) and that the balance of power in the new nation would be upset again.

The resolution was the The New Jersey Plan:

*Congress would have only one house and have an increase in power, including

1. The power to levy import duties and a stamp tax to raise money for its operations

2. The power to regulate trade among the states and with other nations

3. The power to make laws and treaties the supreme law of the land so that no state could make laws that were contrary to them

*An executive branch would be made up of several persons appointed by Congress, they would have the power to administer national laws, appoint other executive officials, and direct military operations

*A supreme court would be appointed by the officials of the executive branch, with the power to decide cases involving treaties, trade among the states, or with other nations, and collection of taxes.
