It is known as Common Law and strictly applies to states, such as the United Kingdom and Commonwealth of Australia, where citizens have no protection under a Code of Laws or Constitution. There is a body of evidence that suggests Precedence is used to describe Judical Descisions as apposed to Black Letter Law that is Legislation as passed by Parliament and given Royal Assent.

It has been the practice that although Black Letter Law may be interpreted by the Courts, Common Law or Preceedence is what is the day to day history and practice of the Law.
