It is not a criminal offense to do so, but using the photo of another without their permission MAY render the used liable civilly, for money damages or to an injunction to stop the use. If the photo was taken in a studio by a photographer for instance, the photographer knows he needs a signed "release" authorizing use of the photo. These can be a general release for any purpose or for only specific purposes. People have no "reasonable expectation of privacy" if they are out in public areas, say, on a public sidewalk. Photos taken there may be used freely. Many photographers would ask for a release anyway, to prevent problems.

Law enforcement are capable of releasing any photo that isn't in direct violation of the expected standards for handling evidence. You may request that a photo not be released, and under most circumstances, I'd assume a reasonable Public Information Officer would try to appease your wishes. But, if the department feels the need to release information that may help solve the crime, they can (and will) do so.
