Maybe, that's a decision that is made by the lender and has nothing to do with a custodial hearing, they are two totally different legal issues. She would have to qualify for refinancing the existing loan or entering into a new mortgage contract with the present or a new lender. If she is under the impression the judge who is presiding over the custody hearing has any jurisdiction as to the home, she is mistaken.
