After being found guilty of the crime for which they were arrested, probation is customarily offered only to first-time-offenders who have committed minor criminal offenses usually involving minor crimes against property (e.g.: petit theft - shoplifting, etc). Probation is usually not offered in crimes against persons, especially not violent crimes.

The law doesn't provide for probation, and there is no guarantee that an offender will be offered probation, it is offered at the discretion of the judge presiding in the case, They may (or may not) review your past record (or lack of one) and decide to grant you a this lenient sentence.

The judge is not required to sentence you to probation and, by law, you are not 'entitled' to it.
