Originally the Europeans attempted to claim the land in American through a variety of acts, each of these were found UNLAWFUL by the courts throughout Europe at the time (F. Victoria c.1532). Through these decisions it was found that there were only three ways to obtain the land legally, one was by Treaty (sell). Europeans then gained legal title to the land by getting these treaties (treaties were almost always single sided as those that refused to sign were shot, and they got someone else to sign), and then promptly killed the treaty signers so they didn't have to abide by, or pay, according to the treaty - this of course was approved of by the courts including the US Supreme Court (after the founding of America - note the Treaty of Fort Pitt 1778; as one example). The United States continued this policy, still in effect today.
