California could ponly be claimed as a part of its occupation during time of war. The failure of Mexico to ratify the Treaty of Velasco was not a US problem, nor was the failure of Texas to comply fully with the terms of that Treaty. The US could at least claim to have been dealing in good faith with the Republic of Texas.

The Texas claim is based on being a break way Republic from Mexico whose claim is based on Spanish exploration and settlement. Since Texas had no exploration of the area in question the Texas claim to lands along the north and eastern banks of the Rio Grande lack merit and standing. But that was all settled effectively in the 1850 compromise. The US did uphold the Texas claim to El Paso and in the County Club border settlement, the Supreme Court also sided against New Mexico.
