What if a disoriented man started vandalizing property of another started shooting and police arrived and shot the man the man then tried to get up and they tasered him what could be his defense?
The only possible defense could be mental incompetence; however, in some states (such as Michigan), that will only delay a trial until the man can be mentally stabilized. If he cannot be, he will remain in custody at a mental health facility, not much better than jail or prison.
The defendant should count himself quite fortunate the police did not shoot him dead and claim defense of themselves or public safety.
