You can clip and trim the trees and bushes on your side of the property line. You cannot go in your neighbors yard. Make sure you know where the property line is by locating pins or having it surveyed.

In most states, you have the right to cut any limbs or branches that hang over the property line. However, it is always best to work with your neighbor about the tree whenever possible (since you have to live next to that person). If your neighbor objects to you cutting limbs that hang over the line, be sure to see a real estate attorney before cutting to avoid violating your state's timber trespass laws.

Can a neighbor prune your bushes on his side to the point that they might die?

If your neighbor prunes your bushes on their side of the property line, they must exercise reasonable care. If their pruning actions are excessive and result in the death of your bushes, they could potentially be held responsible for the damages. It is advisable to communicate with your neighbor and reach a mutual understanding regarding any pruning activities that may affect both sides of the property.

Can a neighbor make you take trees down that are within your own boundary line?

A neighbor cannot make you cut a tree down. BUT if your tree encroaches on a neighbor's property, causes a risk to a neighbor or their property, or causes a situation that prevents a neighbor from full enjoyment of their property, the neighbor can ask a court to make you cut back the limbs that are causing problems for their property. Your rights end where the property line begins; same for your neighbor.

Can you claim your property that is past the fence line if there is a sixty year old fence?

Can a neighbor trim anothers tree without permission?

Yes. The law gives you the right to trim bushes and trees that cross the property line up to the property line. You must use reasonable care in trimming the bushes so that you will not cause damage to the bush (except for removing the parts that cross the property line). If at all possible, talk to your neighbor before trimming.

Is it legal for your neighbor to have your property surveyed?

It depends on what you mean by surveying your property. Most laws allow a surveyor to access abutting property as necessary in order to survey a common property line. Therefore, yes, a surveyor can survey your property line where it abuts your neighbor and make any calculations necessary to set a legal property line.

What is encroachment on property?

An encroachment is an infringement on someone else's rights or intrusion on another person's property. It is most often used when describing real property such as the corner of an neighbor's garage that extends over the property line or a driveway that gradually grew over the property line and is now partly on your neighbor's land. Encroachments are often caused by surveyor error in placing the pins marking the boundaries in a subdivision and the party who built their swimming pool partly on their neighbor's land was not at fault.
