Florida Statute subsection 775.082 states Capital Felony- Death or life imprisonment with no chance of parole.

Sexual battery (as defined in s. 794.011(1)(h), F.S.) of a person under the age of 12 by another person who is 18 or older is a capital felony.
Although, due to case law decisions the offender is not subject to the death penalty.

A non-capital felony is one that is not punishable by the death penalty if the State you're in has a death penalty. In non-death penalty states it's basically a felony that is not punishable by automatic life in prison without parole.

Depends on what they are. In some states, multiple counts of DUI are a felony.... slight difference between that and, say, capital murder.
