Ashley and Humble (December 2005) indicate, "Only a small proportion of those convicted of a Class 4 felony are sentenced to prison." This is presumably due to offenders receiving suspended prison sentences and avoiding actual prison sentences through completion of terms of probation.

The general rule in every state regarding classes of felonies are that the higher the number, the less serious the felony or misdemeanor. For example, a first-class felony, in some states referred to as first-degree felonies, or in some states class A felony, is a felony that is punishable by the most prison term than any of the other felonies. Of course, many states also have a classification of capital felony, which is punishable by life in prison or the death penalty.

In Chicago, felonies are divided into 5 classes. A class X felony is the worst, followed by 1,2,3, and class 4 felonies. They are divided into classes according to severity/nature of the crime and sentencing if the defendant is guilty. A class 2 felony, if convicted, carries a higher sentence than a class 4 conviction, but a lower sentence than a class X felony. The judge decides the sentencing in any case, but each individual class carries a minimum sentence.
