Private schools are regulated by their independent board of directors and can lead the school in any direction it pleases, so long as it satisfies the state educational laws.

In public schools the courts have ruled that a student's First Amendment rights do not end simply by entering the schoolhouse, whereas in a private school this can be controlled more.

Public schools are subject to more strict scrutiny of state and Federal Laws, for example the establishment clause requires that the school cannot aid or hinder religion. This does not mean that the school can completely prohibit religion in cases of after school use of school property for public meetings that are religious centered. See Good News Club v. Milford Central School.

Local property taxes supply the major funding for public schools and may result in scant services in a poor community. Private schools charge tuition and can raise tuition costs when their costs escalate. There is generally less bureaucracy in a private school and changes and modifications can be made sooner. Their operating expenses are often leaner. Public schools must deal with unions and long-standing rules that no longer make any sense. Private schools generally serve a more education-oriented population and student scores are higher in standardized testing. Salaries are higher in public schools than in private schools on the average.

Private schools can be religious-based as long as they meed the standard state requirements in their curriculum while religious teaching or prayer requirements cannot legally be imposed on students in any public school classroom.
