Your question of "What is the minimum sentence for murder?" leaves a lot of unanswered details. Murder involves one person involved in the death of another. The first question to be asked is, "What type of murder?" Murder varies from self defense, to involuntary manslaughter, to voluntary manslaughter, to second degree murder, to first degree murder. Generally, there is no sentence if the jury decides it was self defense. First degree murder involves premeditated murder, murder of a law officer, or murder committed during a felony. The first thing the jury decides is guilt or innocence or self defense. Then the jury decides what kind of murder. In this state the minimums for the amount of prison time are 0 for involuntary manslaughter, 0 for voluntary manslaughter, 10 for second degree murder, and 25 for first degree murder. That does not include time spent under court ordered supervision.

Sentencing varies from state to state and the Federal government. Some states have sentencing guidelines. In Michigan, the Criminal code specifies any term of years up to a life sentence.

In court proceedings is first or second worse?

Since the question was put into the Crime and Criminal Law category, the answer is given in that context. First is worse than second in the sense that a crime of the first degree is worse than a crime of the second degree. First degree murder will call for a more severe penalty than will second degree murder.

What sentence do you get for murder with a knife?

It depends on the circumstances. There is no one sentence given. It also depends on which country you are in at the time. Many still have the death penalty. But given the same circumstances the weapon would make very little difference.

How long and what sentences are given to juvenile third degree murderers in Canada?

There is no such thing as third-degree murder in Canada. Juvenile offenders can be sentenced to a maximum of 10 years confinement for first-degree murder. However, at 14 years of age, an offender charged with murder or manslaughter is automatically tried as an adult unless they can show cause why they should be tried as a juvenile. (Provinces may enact laws to increase that age to 15 or 16).

What happens after a person is hanged to death?

After a person is hanged, the second party is given remedy and the hanged person is justifiably given justice. death penalty is usually given to the persons who commit murder, not only murder but first degree of murder. it is very rare for a person who is convicted of manslaughter to be hanged. if the person is a real murderer it is in the best interest of the society to be hanged. if not so then there is great possibility of the murderer to make the killings his outdoor game.

Can any of the Manson followers still be executed?

Not for the crimes from 40 years ago. If they were to commit another murder inside the prison they could in fact be given a death sentence.

What are the degrees of murder?

First degree: killing with the intent to kill. Usually requires premeditation. Also includes felony murder - an unplanned murder that occurs during the commission of a felony (example is defendant burglarizes a house and during the burglary kills the homeowner - no premeditation but committed during a felony). Second degree: killing with the intent to do harm but not the intent to kill. Example - shooting someone in the leg with the intent to wound but not kill, and the victim bleeds to death. Third degree: killing that resulted from indifference or negligence. Usually there must be a legal duty (parent - child), but can also include crimes like driving drunk and causing a fatal accident. Fourth degree: felony murder committed by an accomplice. Same as felony murder, but instead of one burglar there are two. Burglar A kills the homeowner and that is first degree murder. Burglar B did not take part in the killing but did take part in the burglary and that is fourth degree. These are old terms that are now all but useless except in studying the history of criminal law. The definition of murder is now a matter of whatever the statute in a given state says, even though some may still use the terms.
