A tornado that doesn't touch the ground isn't a tornado; it is a funnel cloud. However if the funnel is pulling debris off the ground or making some other type of contact with the ground it is a tornado.

In order to be considered a tornado the violent winds must reach ground level and be able to produce damage. This does not necessarily mean the funnel has to reach the ground as many tornadoes are capable of producing heavy damage even without that.
