However, in many cases, when an older teenager commits a murder, they are found as "mentally competent", or their thought-process is that of an adult. When this happens, the minor will be charged with murder as an adult.
Once a minor is found as "mentally competent", that ruling is permanent. Any future crime they commit, even as a minor, will be considered an adult offense.

∙ 15y agoThe penalty can be different depending on the age, mental condition, and how it was attempted. There is a kid from around my town. He is 11 yrs old and has hunted since he was 4. He shot his dad's Girlfriend and killed her and the child she was pregnant with. He is being charged as a adult because she was pregnant. If she wasn't pregnant, he would be treated as a juvenile.
