∙ 11y agoAs you stated murder is a first degree felony. Unless it is show at trial that the murder was "under the immediate influence of sudden passion arising from an adequate cause". Then it becomes a second degree felony.
The punishment for a first degree felony is 5 years to life in prison and a fine up to $10,000.
Under Texas law, no one can receive the death penalty for murder. They must commit capital murder. The difference being (to shorten this answer) capital murder is what is considered heinous. Examples include killing a peace officer, kids, for money, more than one person, etc...
